1. General provisions and definitions

1.1. These Terms of Service (the “Terms”) set the rules for access to and use of the Aefia service (the “Service”). By performing acceptance actions, the User fully and unconditionally agrees to these Terms in the version published on the website on the date of acceptance.

1.2. Any rules, restrictions, privacy notices, acceptable use rules, and other documents published on the website and referenced by these Terms form an integral part of these Terms to the extent they do not conflict with non-waivable law.

1.3. The Service is intended exclusively for adults. Access to the Service is not permitted to anyone under 18 years of age or below the legal age for adult content in the User’s jurisdiction.

1.4. In the event of any discrepancy between promotional materials, social content, informal support statements, the checkout interface, and these Terms, the checkout interface and these Terms prevail.

• Operator: The operator of the Service under the Aefia brand (the “Operator”). Support, notices, and payment-related requests are handled through the feedback form available on this page and/or other in-product support channels made available by the Service.

• AI character: A fictional adult-themed AI persona that responds to the User in text chat using artificial intelligence technologies. AI characters are not real persons and do not represent actual consent, emotion, intention, or real-world availability.
• Curated collection: The Service is a curated platform. Characters, descriptions, prompts, and visual materials are created, selected, licensed, or maintained by the Operator and/or its licensors. The Service is not an open marketplace for user-created characters unless expressly stated otherwise in the interface.
• Access period: The period during which the User receives access to paid Service functionality purchased for a selected term.
• One-time crypto purchase: A non-recurring payment model in which the User pays once for a selected access term. Access expires automatically at the end of the paid term unless the User makes a new purchase.
• Payment form: The crypto checkout interface showing the final payable amount, supported network, recipient address, and any required memo/tag before payment confirmation. The data shown in checkout prevails in case of discrepancies.
• Platform rules: The Service is for lawful adult use only. 2. Subject of the Terms

2.1. The Operator provides the User with access to the Aefia adult AI chat functionality and fictional adult AI characters, and the User pays for such access under the selected plan, if a paid plan is chosen.

2.2. The Service is designed for adult AI chat only. This includes private adult conversations, NSFW AI chat, AI girlfriend interactions, erotic roleplay, flirtation, and other intimate text-based scenarios with fictional adult AI girls. The Service is not a game, not an education product, and not a marketplace for user-created characters unless the interface expressly says otherwise.

2.3. Access is provided online. Paid features are activated after successful checkout and the required blockchain/payment confirmations. Activation is usually completed within minutes, but in some cases may take up to 30 minutes due to technical confirmation timing.

2.4. The User understands and agrees that AI-generated answers may contain inaccuracies, hallucinations, inconsistent behavior, or unwanted phrasing. The Service is provided primarily for entertainment and companion-style interaction and does not constitute medical, legal, financial, psychological, crisis, or other professional advice.

2.5. The Service may include stylized illustrations or character visuals if such functionality is available in the interface. Availability of any specific character, scenario, visual set, or response style is not guaranteed and may change over time.

3. Access levels and features

4.1. The price of the Service is determined by the amounts shown on the website and in the crypto checkout form. The exact payable amount, access term, supported network, recipient address, and any required memo/tag are always shown before payment confirmation and prevail in case of discrepancies.

4.2. Paid access is available only via cryptocurrency USDT. The Service may offer one-time access terms such as 1, 3, 6, or 12 months, depending on the interface shown at checkout.

4.4. Access is sold as a one-time purchase for the selected term. No bank cards, no fiat payments, no recurring charges, and no auto-renewal are used for paid access.

4.5. Standard USDT pricing, unless otherwise shown at checkout: 1 month — 9.99 USDT; 3 months — 24.99 USDT; 6 months — 47.99 USDT; 12 months — 89.99 USDT.

4.6. Blockchain transactions are generally irreversible once submitted to the blockchain and/or confirmed. All USDT payments are final and non-refundable, except to the extent non-waivable law explicitly requires otherwise.

4.7. By making a USDT payment, the User expressly understands and agrees to the final and no-refund nature of cryptocurrency payments, the irreversibility of blockchain transactions, and the absence of chargeback mechanisms.

4.8. Access is activated after the required payment confirmation and blockchain confirmation, usually within minutes, but in some cases activation may take up to 30 minutes due to technical specifics of the payment flow.

4.9. The Operator does not store bank card details for paid access because paid access is processed exclusively through USDT crypto checkout.

4.10. Regional pricing, bundles, promotions, and temporary offers may apply. The User sees the final payable amount and access term in checkout before payment and accepts those terms by making the transfer.

5. Technical terms, adult content rules, and data processing

• AS IS / AS AVAILABLE: the Service is provided “as is” and “as available.” The Operator does not guarantee uninterrupted operation, error-free performance, availability of any specific feature, or that the Service will satisfy every subjective expectation of the User.
• AVAILABILITY AND DOWNTIME: temporary downtime, latency, model changes, reply degradation, feature removal, or access limitations may occur due to updates, maintenance, provider outages, blockchain congestion, abuse prevention, or other factors outside the Operator’s reasonable control.
• ANONYMOUS USE AND DATA MINIMIZATION: the Service is designed to minimize the need for real-world identity data. Users should not share real names, phone numbers, addresses, emails, social accounts, wallet seed phrases, passwords, card data, or other sensitive information in chat.
• PAYMENTS: payment data is processed through crypto checkout flows and related infrastructure. The Operator does not receive or store full bank card details because bank card payments are not offered.
• LIMITED DATA PROCESSING: the Service may process account data, chat content, technical logs, device/browser data, IP address, blockchain transaction identifiers, abuse signals, and related technical records for access delivery, security, anti-fraud, moderation, support, incident review, analytics, and service improvement, as further described in the Privacy Policy.
• CURATION AND UGC: the Service is a curated platform. User-generated content within the Service is generally limited to chat text entered by the User unless the interface expressly provides other upload functionality and separate rules.
• ACCOUNT AND ACCESS: the User must keep account credentials confidential and must not share access with third parties. Actions performed through the User’s account are treated as actions of the User unless proven otherwise.
• MODERATION AND ANTI-FRAUD: to enforce platform rules and protect the Service, the Operator may use automated moderation, abuse detection, fraud prevention, rate limits, and selective manual review of support requests or technical incidents.
• ADULT NSFW RULES: the Service is 18+ only. Any request, depiction, simulation, or roleplay involving minors or ambiguous age, incest, bestiality, coercion, assault, exploitation, trafficking, blackmail, sexualized self-harm, non-consensual sexual activity, or other unlawful sexual content is strictly prohibited.

Users must not attempt to obtain real-world contact details, arrange meetings, or conduct personal financial transactions through chat.
• PROHIBITION ON PERSONAL DATA AND PAYMENT DETAILS: Users must not request or share personal data, payment credentials, one-time codes, seed phrases, private keys, account passwords, or similar sensitive data in chats.
• PROHIBITION ON ATTACKS AND BYPASSES: scraping, parsing, automated extraction, reverse engineering, prompt extraction, model extraction, jailbreak attempts, vulnerability probing, bypassing limits, abusive automation, and other actions that interfere with the Service are prohibited.
• PHOTOS AND VISUALS: the Service may use stylized character visuals. Availability of any specific visual output is not guaranteed. If the interface does not allow uploads, Users must not attempt to submit files through bypass methods.
• ACCURACY DISCLAIMER: all outputs are AI-generated and may be fictional, inaccurate, contradictory, or unsuitable for any real-world decision. The User is solely responsible for evaluating and using outputs.
• NO PROFESSIONAL OR EMERGENCY SERVICE: the Service is not a replacement for professional advice, crisis assistance, therapy, emergency support, or any regulated service.
• DATA RETENTION: chats and technical records may be stored for functionality, continuity, moderation, anti-abuse, incident investigation, billing verification, and service improvement. Deletion may be limited by technical, operational, or legal constraints.

6. Rights and intellectual property

• LICENSE: the User receives a limited, non-exclusive, non-transferable, revocable license to use the website interface and Service functionality solely for personal, lawful use in accordance with these Terms.
• OPERATOR RIGHTS: all rights to the Service code, interface, design, prompts, system logic, databases, catalog structure, characters, descriptions, visuals, and other Service materials belong to the Operator and/or its licensors unless expressly stated otherwise.

• AI OUTPUTS: subject to applicable law and third-party rights, the User may use AI-generated outputs for lawful personal or business purposes at their own risk. The User is solely responsible for checking factual accuracy, legality, and suitability.

7. Liability and blocking

• BLOCKING / RESTRICTING ACCESS: the Operator may suspend, restrict, or terminate access without prior notice in cases of suspected fraud, abuse, security risk, rule violations, prohibited sexual content, personal data sharing, illegal content, scraping, automation abuse, prompt extraction, age-related concerns, or other misuse of the Service.
• NO REFUND ON VIOLATION: if access is restricted, suspended, or terminated due to the User’s breach of these Terms, anti-fraud triggers, abuse, unlawful conduct, prohibited content, or infringement-related complaints, paid access fees are not refunded, except to the extent non-waivable law explicitly requires otherwise.
• USER LIABILITY: the User is responsible for complying with applicable law, these Terms, and the platform rules, including the legality of accessing adult content in the User’s jurisdiction and the legality of any use made of AI outputs.
• LIABILITY CAP: to the maximum extent permitted by law, the Operator’s total liability for claims arising out of the Service is limited to the amount paid by the User for the specific disputed access period.
• NO INDIRECT DAMAGES: to the maximum extent permitted by law, the Operator is not liable for lost profits, lost data, reputational harm, emotional disappointment, indirect damages, or consequential damages arising from use of or inability to use the Service.
• FORCE MAJEURE: the Operator is not liable for delay, interruption, or failure caused by events beyond reasonable control, including infrastructure outages, provider failures, sanctions, network disruptions, blockchain congestion, abuse attacks, natural disasters, government actions, or similar events.

8. Final provisions

• CLAIMS AND SUPPORT: support requests, disputes, payment verification requests, and formal notices must be submitted through the feedback form on this page or another official in-product contact channel if provided. General response time may be up to 30 days.
• CHANGES: the Operator may update these Terms at any time by publishing a new version on the website. The updated version becomes effective upon publication unless otherwise stated.
• APPLICABLE LAW: these Terms apply to the maximum extent permitted by applicable law. Nothing in these Terms limits non-waivable rights that a User may have under consumer protection or other mandatory law.
• SEVERABILITY: if any provision of these Terms is found unenforceable or invalid, the remaining provisions remain in full force and effect.
